These Terms & Conditions govern the use of amagee.co (the "Site") and the purchase of products from AMAGEE. By placing an order, you agree to these terms. Please read them together with our [Privacy Policy], [Cookie Policy], and [Shipping & Returns] page.

1. Who we are

2. Our products

AMAGEE offers ready-to-wear apparel produced in limited runs. Because our pieces are made in small quantities and photographed under different conditions, slight variations in colour, texture and finish are natural and are not considered defects.

All products are subject to availability. We may update or discontinue any product at any time.

3. Prices

All prices are shown in euros (€) and include applicable VAT. Delivery is included in the price. There are no additional shipping charges at checkout.

We take care to ensure prices are correct, but if we discover an error in the price of goods you have ordered, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order.

4. Orders and contract

When you place an order, you will receive an order confirmation by email. This confirms we have received your order; the contract of sale is formed when we dispatch the goods. We reserve the right to refuse or cancel an order (for example, where an item is out of stock or a pricing error has occurred), in which case any payment taken will be refunded.

5. Payment

Payment is taken at the time of order through the payment methods offered at checkout. All payments are processed securely by our payment providers; we do not store your full card details.

6. Shipping and delivery

We currently ship to all 27 member states of the European Union. Orders are dispatched within 2 business days and delivered by our carrier. Full details are on our [Shipping & Returns] page. In line with EU law, we deliver within 30 days at the latest.

7. Right of withdrawal and returns

As a consumer, you have a 14-day right of withdrawal and may return items as set out on our [Shipping & Returns] page, which forms part of these terms.

8. Legal guarantee of conformity

You benefit from the legal guarantee of conformity: if an item is faulty, not as described, or not as could reasonably be expected, you are entitled to a repair, replacement, price reduction or refund at no cost. This applies for a minimum of 2 years under EU law (3 years under Spanish law for goods purchased from 1 January 2022).

9. Intellectual property

All content on the Site, including the AMAGEE name, logo, designs, images, and text, is owned by us or our licensors and is protected by intellectual property law. You may not reproduce or use it without our written permission.

10. Liability

Nothing in these terms limits your statutory rights as a consumer or our liability for matters that cannot be limited by law. Beyond this, we are not liable for indirect or unforeseeable losses arising from the use of the Site or our products.

11. Governing law and disputes

These terms are governed by Spanish law, without prejudice to the mandatory consumer-protection rules of your country of residence within the EU.

If you have a complaint, please contact us first at info@amagee.co so we can try to resolve it. As a consumer, you may also be entitled to use out-of-court dispute resolution through the competent consumer protection authorities.
